Sheppard / Mandalay Homes Update: (Updated August 16, 2007)

I spoke with Harry Morgan at Colorado Community Bank regarding the Sheppard property located at 4420 Georgetown Drive. Harry hired an inspector to determine if the existing structure was structurally sound, or if it needed to be torn down. The inspector determined that the structure was structurally sound, and could be completed.

The bank has hired a local builder to finish roofing the house, which should be completed by 08.20.07. Once the roof is completed, the bank plans to “dry-in” the home, to provide a safe environment and aesthetic improvement. This will include installing windows, doors, garage doors and siding. The bank is currently in the process of bidding out stucco and stone for the exterior as well. Once those items are complete, the bank will have to put construction completion of the home on hold, because of its status in the foreclosure process. There are currently several liens against the property, and the bank cannot continue construction until the home has been foreclosed upon. The foreclosure may take up to 75 days. One option that the bank is hoping for is that Chuck Sheppard will waive his (foreclosure) redemption rights, and then they would cure the liens and continue the construction and completion of the home. If they are able to move forward with that scenario, then they would be able to resume the interior construction and completion of the home once the foreclosure proceedings have been finalized.



Water Quality Pond Information: (Updated August 16, 2007)

We spoke with Kevin Gingery, the City’s drainage engineer regarding the ownership/maintenance of the water quality features.

Kevin said that the City’s ownership goes up to the end of the pipe that enters the water quality pond. After that, the HOA owns and maintains the pond and the water outlet structure.

The structure is operating as it should. The holes in the plate where the water passes through are clean and the water is flowing freely. It is a very slow process to empty the pond. This is the way it was designed. Every time there is a rain, the pond quickly fills back up to the top and begins the slow draining process all over again. The flow from irrigation runoff tends to contribute to keeping the pond full. So long as the holes in the outlet plate are kept clean and open, I do not know what else can be done.



What’s been happening in the community: (Updated December 8, 2006)

1. Proxies will be sent to all homeowners moving forward to ratify budgets for the association.

2. The water quality pond on the northeast corner of Dumont and Georgetown has been looked at by the Board and the following was decided:

a. A lock and chain will be placed on the gate to secure the area.
b. The developer will meet with the landscaper and come up with some ideas for a landscape buffer along Georgetown Drive to screen this area from residents in the community.
c. The water quality pond area will be cleaned of trash and debris.

3. Newsletters.
Management Specialists will produce a quarterly newsletter mailed to all members. A resident of Kendall Brook has volunteered to work with them, the Advisory Board, and Board members, to assist in the newsletter's content and composition. Direct input for the newsletter to Management Specialists. The date of the next newsletter will be announced shortly.

4. The snow removal company has been contacted to ensure they no longer stack snow piles next to the gang mail boxes in the neighborhood.

5. The Board has decided to form an Advisory Board of 7 homeowners to help address issues and problems that may occur in the subdivision. Information on the Advisory Board will be sent out in the next mailing. The Board would like some brief history on each volunteer as well as why they should be considered to serve on the Advisory Board.

6. The proposal for the community pool has been defeated and will not be built in the Kendall Brook community.

7. The Board has decided to separate the current fine policy for covenant violations. The current fine policy will remain in effect for minor covenant violations; however, a new more stringent fine policy is being drafted for major covenant violations. Once this policy has been amended, the information on the new fine policies will be posted on the website.

8. The Board inspected the Kendall Brook community on December 5, 2006 and addressed several covenant violations with the management company. The following items are currently being addressed:
a. Fence violations
b. Landscaping violations
c. Unsightly debris on lots
d. Fence staining throughout Phases I & II
e. Exposed electrical and gas conduit
